San Diego sheriff's deputy fatally shoots suspect during struggle

A San Diego County sheriff's deputy shot and killed a man in Valley Center during a street fight in which the man wrested away the deputy's baton, officials said Tuesday.
Deputies had responded to a call Monday about a "suspicious person" in the northern San Diego County neighborhood, according to a sheriff's department report. While deputies attempted to interview the man about a possible arrest warrant, he fled and deputies chased him.
A Taser shot had no effect on the man, nor did blows from a deputy's baton, the report said.
"At some point during the struggle, the male was able to gain control of the deputy's baton," the report said. "At this point, the deputy fired several rounds, striking the suspect."
The man, whose name and age were not released, was pronounced dead at a hospital. The U.S. Border Patrol is assisting in the investigation.
